Rewards Terms

  1. Introduction

By registering on the Payap app (“Payap”), you accept these terms.  These terms apply to the rewards programme we provide through Payap (“Payap Rewards”) and to any third party rewards or loyalty programmes available through Payap from time to time (“Third Party Rewards”).

Please read these terms carefully.  Together with our Terms of Use, the Payap Privacy Policy and the BNZ Master Privacy Policy, these terms make a legally binding contract between you (referred to as “you” in these terms) and us (Bank of New Zealand, New Zealand company number 428849, referred to as “we” or “us” in these terms).

  1. Changes to rewards or these terms

We may change, suspend, replace or withdraw Payap Rewards or Third Party Rewards at any time without prior notice, including making changes to the eligibility, calculation, awarding, earn rate or redemption rate of Payap rewards points (“Payap Points”) or points or rewards available under Third Party Rewards.

We will publish changes to these terms on the Payap website, and we may also choose to notify you by email to the address you have listed for your account.  We will give you at least 14 days’ notice before those changes become effective, except for any changes made to protect the security of our systems or to comply with a change in law, which will take effect at the time those changes are made, unless we specify otherwise. 

By continuing to use Payap, you will be taken to have accepted the latest version of these terms, and it is your responsibility to check for any changes.  If you are not happy with any changes, you can opt out of Payap Rewards on Payap or you can close your account on Payap at any time.

  1. Payap rewards

Earning points
You may earn Payap Points through your participation in Payap Rewards, and your actions and interactions with Payap, as we provide or determine from time to time. 

Payap Points you’ve earned may take up to 10 business days to appear in your Payap Points balance on Payap. 

You can view your Payap Points balance on Payap.

You will not be eligible to participate in Payap Rewards or earn Payap Points if you are in trade and are using Payap in trade.

Redeeming points
You may redeem your Payap Points for a good or service or an entitlement to a good or service (a “Payap Rewards Benefit”) as we provide on Payap at the time of redemption.

Redemption of Payap Points for Payap Rewards Benefits may be subject to requirements of minimum numbers of Payap Points and a redemption rate, as we provide or determine from time to time.  When you redeem your Payap Points for a Payap Rewards Benefit, the corresponding number of Payap Points will be deducted from your Payap Points balance, with the oldest Payap Points redeemed first.

Once Payap Points have been redeemed or Payap Rewards Benefits issued, that redemption cannot be reversed and the Payap Rewards Benefits issued cannot be returned, exchanged, substituted or altered.

Payap Rewards Benefits are subject to availability, substitution and cancellation.  At any time and without prior notice, we or any third party provider of Payap Rewards Benefits may change the Payap Rewards Benefits available, including by withdrawing, limiting, modifying or cancelling a Payap Rewards Benefit or amending the number of Payap Points required to claim a Payap Rewards Benefit.

Only you can redeem your Payap Points.  You must not have breached these terms or the Payap Terms of Use at the time you redeem your Payap Points.

Exclusions and expiry
Your Payap Points cannot be redeemed or exchanged for cash or any other payment option.  You may not sell or transfer your Payap Points to any other person.

Payap Points must be redeemed within 36 months of the date on which the Payap Points are issued.  Any Payap Points that remain unused after that period will automatically expire and be forfeited.

Points balance
Your Payap Points balance is reduced when: (i) you redeem your Payap Points for Payap Rewards Benefits; (ii) your Payap Points expire; (iii) Payap Points were incorrectly allocated to your Payap Points balance, or you earned Payap Points for an action or interaction that was reversed; or (iv) we reasonably suspect you may have behaved fraudulently or in breach of these terms in connection with Payap Rewards and you are not entitled to the Payap Points earned.

Following any of these actions, your Payap Points balance will be reduced by the Payap Points value of the adjustment.  This might mean your Payap Points balance becomes negative.

The value of Payap Points will be the number of Payap Points assigned to the Payap Rewards Benefits when we process the adjustment. This rate may differ from the rate that applied when the Payap Points were earned.

  1. Cancelling your participation

You may opt out of Payap Rewards by selecting that option in Payap.  You can opt back in at any time.

From the date you opt out your participation in Payap Rewards will be automatically cancelled.  Your participation in Payap Rewards will also be automatically cancelled from the date you no longer hold a Payap account.

Once your participation in Payap Rewards has been cancelled, any remaining Payap Points you have will be forfeited. We recommend you redeem any unused Payap Points at least 10 business days before opting out or closing your Payap account. 

We may suspend or terminate your participation in Payap Rewards in our sole discretion at any time.

  1. Third party rewards and loyalty programmes

We or any third party may make Third Party Rewards available through Payap from time to time.  Third Party Rewards may enable you to access a good or service or entitlement to a good or service, under a third party loyalty or rewards programme, as provided by a third party from time to time (a “Third Party Rewards Benefit”).

Third Party Rewards are subject to the terms and conditions of the provider of the relevant third party loyalty or rewards programme.  We have no liability to you in relation to Third Party Rewards or the applicable terms and conditions for Third Party Rewards.

We are not responsible for any Third Party Rewards Benefits you claim, receive or are entitled to from any third party rewards or loyalty programme provider.  Any dispute about a Third Party Rewards Benefit, or your claim, receipt or entitlement to that benefit, from another rewards or loyalty programme provider must be settled between you and them, and we will not be responsible to do this for you.

We may suspend or terminate your participation in Third Party Rewards or the availability of Third Party Rewards on Payap in our sole discretion at any time.

  1. Tax

You are responsible for any taxes payable in connection with Payap Rewards, Payap Points and any Third Party Rewards. We provide no advice or representation regarding tax matters.

  1. Commission

We and other rewards or loyalty programme providers may receive a commission when you redeem your Payap Points or obtain any Third Party Rewards Benefits under Third Party Rewards.  You consent to any such commission being received by us and other rewards or loyalty programme providers.

  1. Personal information

We may receive and disclose personal information with other rewards or loyalty programme providers to provide certain Payap Rewards Benefits, Third Party Rewards Benefits, and services relating to Payap Rewards and Third Party Rewards, in accordance with our Payap Privacy Policy and the BNZ Master Privacy Policy.  For more information about how any other rewards or loyalty programme providers that may participate in Payap Rewards or provide Third Party Rewards from time to time manage personal information, please see their respective privacy policies.

  1. Liability

We will not be liable for any direct or indirect loss or damage you suffer through your participation in, or our withdrawal or replacement of, or changes to, Payap Rewards or Third Party Rewards.  This exclusion applies to all liability (including for negligence), regardless of the legal basis of the claim, to the extent permitted by law.  However, unless you are using Payap in the course of your business, nothing in these terms takes away from your rights under New Zealand’s Fair Trading Act 1986 and Consumer Guarantees Act 1993.

  1. Governing law and jurisdiction

These terms are governed by New Zealand law.  Any disputes relating to these terms, Payap Rewards or Third Party Rewards may be brought by you or us only in the courts of New Zealand.
